RIGHTS OF THE DATA SUBJECT

Within the scope of Article 11 of the Law on the Protection of Personal Data No. 6698 and related legislation, everyone has the right to apply to our Clinic, which holds the title of data controller, regarding the following matters:

a) To learn whether personal data is being processed,
b) If personal data has been processed, to request information regarding this,
c) To learn the purpose of processing personal data and whether they are used in accordance with this purpose,
ç) To know the third parties, in Turkey or abroad, to whom personal data has been transferred,
d) To request correction of personal data if they have been processed incompletely or inaccurately,
e) To request the deletion or destruction of personal data within the framework of the conditions set forth in Article 7 of the Law No. 6698,
f) To request that the processes carried out pursuant to subparagraphs (d) and (e) be notified to third parties to whom the personal data has been transferred,
g) To object to the occurrence of a result against the individual by analyzing the processed data exclusively through automated systems,
ğ) To demand compensation for damages arising from the unlawful processing of personal data.

METHOD AND PRINCIPLES OF APPLICATION TO THE DATA CONTROLLER BY THE DATA SUBJECT

Pursuant to Article 13, paragraph 1 of the KVKK (Law on the Protection of Personal Data) and the Communiqué on the Principles and Procedures for Application to the Data Controller published in the Official Gazette dated 10.03.2018 and numbered 30356, applications to our Clinic, as the data controller, regarding these rights must be submitted through one of the methods specified below or through other methods determined by the Personal Data Protection Board (“Board”).

The data subject may exercise all of the rights granted under Article 11 of the Law No. 6698 and related legislation by applying:

In writing,

With a secure electronic signature,

Via Registered Electronic Mail (KEP) address,

With a mobile signature,

From the email address previously notified by the data subject to the data controller and recorded in the data controller's system.

The following information must be included in the application:

Full name and signature if the application is in written form,

Turkish ID number for Turkish citizens; nationality, passport number, or ID number (if available) for foreign nationals,

Residential or workplace address for notification purposes,

If available, email address, telephone, and fax number for notification,

Subject of the request.

If available, any information or documents related to the request should be attached to the application.

In written applications, the date the documents are received by the data controller or its representative will be considered the application date.
For applications made via other methods, the date the application reaches the data controller will be considered the application date.

The application will be finalized free of charge as soon as possible and within thirty days at the latest, depending on the nature of the request. However, if the process requires an additional cost, the fee determined by the Board may be charged.

Applications must be made by the data subject themselves. Applications on behalf of another person can only be made with a power of attorney, provided that the content includes a request for information in accordance with the KVKK. If there is any doubt regarding the identity of the applicant, the data controller may request verification information from the data subject.
